Trust and Estate Litigation
For many Texas families, the family ranch is their largest, most valued asset. Today, many family ranches are owned by family trusts and family limited partnerships, with select family members serving as trustee or general partner. Unfortunately, as properties are passed down through generations, disputes arise as to the continued operation of the ranch or the distribution of related assets. Under Texas law, those selected to serve as trustee, general partner or executor assume certain fidiciary responsibilities. SpiVal represents trustees, executors, general partners, beneficiaries and limited partners in disputes concerning the management and operations of ranch property. Spivey Valenciano has prosecuted and defended fiduciary related claims brought by and against trustees, executors and general partners in real estate law cases involving large ranches. If ultimately a ranch must be partitioned, SpiVal will work with experienced appraisers and land planners to assist clients in a proper partition of the family property. SpiVal also represents clients in trust and estate litigation that does not involve ranch property.
Oil and Gas Litigation
It has been widely reported that the Eagle Ford Shale development is the single largest economic stimulus that South Texas has ever seen. Mineral and royalty interests in South Texas are extremely valuable and owners of mineral interests and non-participating royalty interests must vigilantly protect their interests to make sure that their rights are recognized and that they are compensated appropriately. In addition, Oil and Gas Law disputes often arise between oil companies and other mineral interest owners as to the ownership and validity of mineral interests with respect to properties under active or contemplated production. SpiVal has obtained division orders for clients whose interests had not been recognized and have successfully defended adverse possession claims. We also represent mineral owners and royalty owners throughout South Texas in related oil and gas disputes. Spivey Valenciano will work with title examiners, appraisers and other experts in protecting their client's oil and gas interests.
